1. Acceptance of Terms

By accessing or using Whip ("the Service") at whipquotes.com, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. Whip is operated by Gabe Whipple, a sole proprietor based in Fort Collins, Colorado.

2. Description of Service

Whip is a quoting platform that allows contractors to create, send, and track job quotes via SMS and email. Customers receive a link to view and respond to quotes. Whip does not guarantee job outcomes, customer responses, or business results.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at support@whipquotes.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use Whip to:

• Send unsolicited or spam messages
• Harass, threaten, or defraud customers
• Violate any applicable laws or regulations
• Transmit false, misleading, or deceptive quote information
• Attempt to reverse-engineer or tamper with the platform

You are solely responsible for the content of quotes you send and for obtaining any necessary consent from your customers to receive SMS and email communications.

5. SMS Communications

By entering a customer's phone number into Whip, you represent that you have a legitimate business relationship with that customer and that sending them a quote via SMS is appropriate. You agree to comply with all applicable SMS regulations including the Telephone Consumer Protection Act (TCPA). Whip is not liable for regulatory violations arising from your use of SMS delivery.

6. Subscription and Billing

Whip is currently in free public beta — all features including unlimited quotes are free of charge. Paid plans will be introduced in the future with at least 30 days notice to existing users.

7. Intellectual Property

Whip and its underlying software, design, and content are owned by Gabe Whipple. You retain ownership of the quote content you create. By using the Service, you grant us a limited license to store and transmit your content solely to operate the platform.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that SMS and email delivery will always succeed. Carrier delivery is outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, Whip and Gabe Whipple shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost profits, missed jobs, or failed deliveries. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

We may suspend or terminate your access to Whip at any time for violation of these Terms or for any other reason with reasonable notice. You may delete your account at any time from the settings page.

11. Governing Law

These Terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in the courts of Larimer County, Colorado.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will notify registered users of material changes by email.
